Bangladeshi Client Marijuana Conviction Vacated

One Bangladeshi client no longer has fear from DHS for a prior marijuana conviction. The conviction was entered after an unconstitutional plea deal, where the client had not been advised of possible immigration consequences. With cooperation from the U.S. Department of Homeland Security, David F. Vedder, P.A., secured transportation of the client from Krome Processing Center in Miami, Florida to attend a criminal hearing. Attorney David F. Vedder personally attended the hearing before the Florida Circuit Judge in Deland, Florida to testify as an expert witness in the motion to vacate a felony conviction of a crime relating to a controlled substance. The conviction, if not vacated, would have resulted in the client’s deportation. Mr. Vedder’s proffered testimony related to the immigration consequences of our client’s plea to the charge. The parties stipulated to vacate the conviction and re-plea, and Mr. Vedder was released as a witness.
