DHS announces temporary protected status for Afghan nationals

On Behalf of | Apr 4, 2022 | Immigration Law

With armed conflict continuing to rage in Afghanistan, the situation is dire for civilians on the ground. Islamic State- Khorasan (IS-K) continues to seek further dominance over the population, utilizing methods that include violent attacks against innocents.

The United States, among other nations, has engaged in a joint evacuation effort, with many Afghan nationals being granted residency for a period of two years, which includes authorization to work. The Department Of Homeland Security (DHS) has continued to bestow further rights on allies who have supported humanitarian missions over the past two decades, as well as Afghan nationals in the most vulnerable conditions, through the implementation of Temporary Protected Status (TPS).

What is Temporary Protected Status (TPS)?

Secretary Alejandro N. Mayorkas announced the policy which has the fundamental aim of protecting Afghan nationals already stationed in the U.S. from having to return to the perils of their homeland. The measure offers further residency rights for those who have been evacuated, for a period of 18 months.

Afghan nationals who have been residing in the U.S. prior to March 15, 2022, will be eligible for the program provided that all relevant security checks are satisfied. It is important to note that anyone who has traveled to the country after March 15, 2022, will be excluded from the provisions.

If you have questions regarding your rights to residency in the U.S., then it is important to explore all of your legal options in further detail.
