How To Get A Waiver Of Grounds Of Inadmissibility

To obtain a waiver of grounds of inadmissibility, you must apply for a separate process from your visa or other immigration applications that you are currently filing. This requires that you file one of two documents, either an I-601 if you are currently outside of the United States or an I-601a if you are already inside the United States. These areas are both called an application for waiver of grounds of inadmissibility. There is a $930 filing fee attached to these documents, although certain individuals may qualify for a fee waiver.

You will need to include a large amount of required evidence alongside the documents that you submit to the United States Citizenship and Immigration Services (USCIS), supporting why you should be granted a waiver. The length of time you will be waiting for depends on which document you file. An I-601 currently takes, on average, two years to complete, while an I-601a currently has a wait time of 44 months on average.
